GENERAL TERMS AND CONDITIONS
1. Contracting parties to the General Terms and Conditions and their scope
1.1. Contracting parties. These General Terms and Conditions (hereinafter: the GTC) govern the rights and obligations relating to the services between Bonyai es Balogh Online Kereskedelmi Korlatolt Felelossegu Tarsasag (hereinafter: the Service Provider) and the users of the electronic commerce services provided by it through the retro-games.hu online portal (hereinafter: the Webshop) (hereinafter: the Buyer; the Service Provider/Webshop and the Buyer together: the Parties). For the purposes of these GTC, the Buyer means any natural person, legal entity, or organization without legal personality to whom the Service Provider sells goods through the Webshop.

1.4. Scope of the GTC. These GTC apply to the sale of all commercial items marketed by the Service Provider through this website, regardless of the goods to be sold and the person of the Buyer. By accepting the Service Provider's offer, the Buyer simultaneously accepts these GTC. The scope of these GTC extends to all electronic commerce services provided within the territory of Hungary through the Webshop. Orders placed for these services qualify as contracts concluded in writing. The language of the contract is Hungarian and English.
1.5. Accessibility of the GTC. The GTC are public. The Service Provider considers it particularly important and does everything necessary to ensure that Buyers can familiarize themselves with these terms before the contractual relationship with the Service Provider is established.
2. Range of products that can be ordered
The range of products available in the Webshop that may be ordered and purchased by the Buyer can be viewed on the Webshop website, while the specification and price of each individual product are available by clicking on the given product. The product specification contains the exact name and description of the product.
3. Purchase price of the products that can be ordered
3.1. Meaning and content of the purchase price. The purchase price of the products is always the purchase price indicated next to the given product in Hungarian forints. The purchase price of the products does not include shipping costs.
3.2. Right to change prices. The Service Provider reserves the right to change the prices shown in the Webshop. The price change takes effect when it appears in the Webshop. The Service Provider guarantees that any price change that may arise after the offer between the Parties becomes binding and has been accepted by the Service Provider does not affect the purchase price of products already ordered.
3.3. Provisions regarding incorrectly displayed prices. The Service Provider assumes no liability for prices displayed incorrectly despite due care, or for errors attributable to the technical service provider operating the website or the IT system (for example, a price of HUF 0 or HUF 1 displayed due to an obvious system error), or for obviously incorrect and unrealistic prices that differ significantly from the generally known market value of the product. In such cases, the Service Provider is not obliged to provide the product at the incorrect price displayed in the Webshop, but offers delivery at the correct price in the order confirmation, in light of which the Buyer may, at their discretion, either order the product at the correct price or withdraw from the intention to purchase without enforcing any adverse legal consequences against the Service Provider and without any obligation on the part of the Buyer.
4. The purchase process
4.1. Adding products to the cart: The product the Buyer wishes to purchase must be placed in the cart. By clicking the Cart icon, the cart contents can be viewed, and the Webshop informs the Buyer about the content of the cart, which the Buyer may change freely until the order is submitted.
4.2. Providing the Buyer's data: If the Buyer wishes to purchase the content of the cart, in the next step the following data must be provided:
a. Selection of delivery method: personal pickup or delivery
b. Within the scope of providing the shipping address, the following data may be given:
i. the Buyer may indicate whether they are purchasing as a private individual or as a corporate customer (in the case of a corporate order, the company name, tax number, registration number and bank account number must also be provided)
ii. shipping details: country, postal code, city, address, name, phone number, contact email address; the Buyer may also provide additional information in the Comment field
c. Selection of payment method: the Buyer may choose from the available payment options, bank transfer in advance (bank and PayPal), cash on delivery, online bank card payment (introduction in progress).
4.3. Finalizing the order: the Buyer can finalize the order by clicking the Order button. Finalization of the order is conditional upon acceptance of the GTC and the Privacy Statement. Before and at the same time as activating the Order button, the Service Provider clearly and visibly indicates the product name, the total amount payable (product price + shipping + other costs), and the fact of the payment obligation. The Order button clearly indicates that pressing it creates a payment obligation.
4.4. Payment of the purchase price: In the case of online bank card payment, the Webshop redirects the Buyer to the payment interface, and after successful payment the Order details are displayed.
4.5. Acceptance of the order by the Service Provider takes place in a two-step process:
a. The Webshop's IT system sends an automatic email confirmation of the Order. Its sole purpose is to enable the Buyer to check the order details and to receive information that the order has been submitted to the Webshop
b. The Webshop informs the Buyer by email about acceptance of the Order.
4.6. The Buyer's options for correcting data entry errors: The Buyer may correct data entry errors until the order is sent to the Service Provider. If the incorrect data cannot be modified in the Webshop or finalization of the order means there is no longer an option to do so, then the Buyer may notify the Service Provider by email address or phone as specified in the GTC.
SimplePay credit card payment (OTP Group)
The SimplePay Online Payment System is developed and operated by SimplePay Plc. SimplePay Plc. is a member of the OTP Group.
Customers using the service may choose SimplePay’s simple and secure payment solution when shopping online. In this case, they can complete their payment on the familiar SimplePay interface.
The payment process is identical to the payment procedure offered במסגרת similar services provided by banks. During the service, SimplePay continuously monitors transactions, keeping the security of users and cardholders in mind, and provides assistance in preventing unexpected events.
WHAT ARE THE STEPS OF THE TRANSACTION?
- By clicking the “Payment” button, you will be redirected to the SimplePay payment page, where you can initiate the transaction by entering your bank card details.
- After entering your card details, please check that the information provided is correct.
- The transaction processing then starts in the bank processing systems.
- You will also be notified of the result of the payment by e-mail, and the SimplePay system will redirect you back to the webshop.
SimplePay credit card payment (OTP Group)
I acknowledge that the following personal data stored in the user database of retro-games.hu by the data controller Bonyai és Balogh Online Kereskedelmi Korlátolt Felelősségű Társaság (Hungary, 1016 Budapest, Aladár utca 19., 5th floor, door 2) will be transferred to SimplePay Plc., acting as data processor. The scope of the data transferred by the data controller is as follows: name, e-mail address, phone number, billing address, and shipping address.

5. Delivery
5.1. Delivery address. The product selected and ordered with the intention to purchase will be delivered by the Service Provider to the shipping address specified by the Buyer or to a parcel locker. The shipping address may differ from the billing address. The shipping address or parcel locker provided when placing the order cannot be modified afterwards.
5.2. Delivery service providers. Delivery of the ordered goods is carried out using the services of Magyar Posta and Foxpost.
5.3. Delivery deadline. The delivery deadline depends on the selected delivery method. Within Hungary it is generally 2-5 working days; in the case of international delivery it is the period indicated in the order.
5.4. Delivery fee. The delivery fee depends on the ordered quantity and their weight, and the exact amount is calculated by the Service Provider when placing the order. The delivery fee is valid for a one-time delivery to the specified shipping address.
5.5. Unclaimed shipments. If, due to the Buyer's fault, the goods are not handed over (for example the Buyer is not at home, provides an incorrect address, or cannot pay the price of the goods), then the Buyer is obliged to reimburse the cost of repeated delivery, even if it would otherwise be free. If unsuccessful delivery occurs two or more times from one address or by the same Buyer, the Service Provider will thereafter send new goods to that Buyer or address only in the case of advance payment, about which the Service Provider informs the Buyer in accordance with the rules applicable to order confirmation.
5.5. Packaging of shipments. The Buyer is obliged to check the integrity of the product packaging upon receipt and, in the event of proper performance, to accept the product, thereby acknowledging the fact, place and time of performance. If this occurs, the Service Provider will not accept complaints relating to deficiencies. The Service Provider always ensures proper packaging suitable for transport. If, upon receipt, the Buyer notices any visible damage to the package, they are entitled to refuse acceptance. Damage arising during transport is the responsibility of the carrier, according to the separate contract in force between the Service Provider and the given carrier.
6. Payment
The Buyer always pays the purchase price for the ordered product in Hungarian forints, using the method selected at the time of the order.
7. Right of withdrawal of a Buyer qualifying as a consumer
The Service Provider draws the Buyer's attention to the fact that the right of withdrawal under this chapter is granted exclusively to Buyers qualifying as consumers; a consumer is a natural person acting outside their profession, self-employed occupation, or business activity.
7.1. 14-day right of withdrawal
In the case of online purchases and contracts concluded away from business premises, the Buyer has the right to withdraw within fourteen days without giving any reason.
If the Buyer has concluded a contract for the provision of services and, at the Buyer's express request, performance of the service has already begun within the fourteen-day period, then the Buyer has a right of termination in respect of the service contract.
7.2. Start and calculation of the withdrawal period
In the case of the sale of goods, the withdrawal period is fourteen days from the day of receipt of the goods. If several goods are purchased and they are delivered at different times, the fourteen-day period is counted from the receipt of the last good received. If goods consisting of several items or pieces are ordered, the period starts from the day of receipt of the last item or piece received.
In the case of regular delivery of goods, where the goods are delivered regularly to the Buyer within a specified period, the withdrawal period is fourteen days from the day of receipt of the first delivery.
The recipient of the goods may be the Buyer personally or a third person designated by the Buyer, other than the carrier.
7.3. Early exercise of the right of withdrawal
In the case of purchasing goods, the Buyer may exercise the right of withdrawal not only after receipt of the goods, but also during the period between the date of conclusion of the contract and the date of receipt of the goods.
7.4. Withdrawal of the offer
If the contract is concluded on the basis of an offer made by the Buyer, the Buyer is entitled to withdraw that offer before the contract is concluded, thereby terminating the binding effect of the offer to conclude the contract.
7.5. Method and deadline for exercising rights
The Buyer may exercise the right of withdrawal or termination in writing, by means of an unambiguous declaration, or by using the model withdrawal/termination statement set out in Annex 2 of Government Decree 45/2014. (II. 26.) on the detailed rules of contracts between consumers and businesses. The exercise of the right shall be deemed timely if the Buyer sends the declaration to the Service Provider before the expiry of the fourteen-day period.
7.6. Legal consequences of withdrawal or termination
Obligations of the Service Provider in the event of withdrawal or termination
7.6.1. Refund of the purchase price
If the Buyer lawfully exercises the right of withdrawal or termination, the Service Provider shall refund without delay, but no later than within fourteen days from becoming aware of the withdrawal, the full amount paid by the Buyer as consideration. This also includes costs incurred in connection with performance, including delivery charges.
7.6.2. Method of refunding the purchase price
The Service Provider refunds the amount due using the same payment method originally used by the Buyer.
With the Buyer's express consent, the Service Provider may also use another payment method for the refund; however, the Buyer shall not bear any additional charge as a result.
7.6.3. Special delivery costs
If the Buyer expressly chose a delivery method other than the least expensive standard delivery method, the Service Provider is not obliged to reimburse the additional costs arising from this.
7.6.4. Right of retention
In the case of the sale of goods, the Service Provider is entitled to withhold the refund of the purchase price until the Buyer has returned the goods or has provided conclusive proof that they have sent them back. Of these two dates, the Service Provider takes the earlier one into account. This right of retention does not apply if the Service Provider undertook to collect the goods itself.
Obligations of the Buyer in the event of withdrawal or termination
7.6.5. Return of goods
In the event of withdrawal, the Buyer is obliged to send back or hand over the goods to the Service Provider without undue delay, but no later than within fourteen days from the communication of the withdrawal. The return is deemed timely if the Buyer sends the goods before expiry of the deadline. This obligation does not apply if the Service Provider has undertaken to transport the goods back itself.
7.6.6. Costs of return
The direct cost of returning the goods is generally borne by the Buyer, except where the Service Provider has undertaken to bear that cost. If, in the case of a contract concluded away from business premises, the goods were delivered to the address requested by the Buyer and the nature of the goods means they cannot be returned by post, then the Service Provider shall transport the goods back at its own expense.
7.6.8. Liability for depreciation
The Buyer is liable only for depreciation resulting from use beyond what is necessary to establish the nature, characteristics and functioning of the goods. If the Service Provider did not provide the necessary information on the right of withdrawal, then the Buyer is not liable for depreciation.
7.6.9. When may the right of withdrawal not be exercised?
The Buyer does not have a right of withdrawal in the case of purchasing new products in sealed packaging if that packaging has already been opened.
8. Complaints and warranty
Any warranty issues may be reported to customer service, where the Service Provider records the circumstances described by the Buyer in an official report form. In the case of a complaint, the Service Provider agrees with the Buyer on the place and time of collection of the product. The Buyer may enforce a warranty claim relating to the product only together with the invoice issued for the product and enclosed with it in every case.
Warranty does not apply to:
- damage and defects resulting from improper use or violent external impact,
- if the product proven to have been received by the Buyer is damaged or destroyed due to an event arising within the Buyer's sphere of interest,
- if the Buyer or another person not acting on behalf of the Service Provider has modified or repaired the product,
- defects or shortcomings indicated on the invoice that were known to the Buyer and for which the Buyer received a price reduction.
Beyond the above, warranty matters are governed by Act V of 2013 on the Civil Code of Hungary, Act XXXVI of 2002 on the law-harmonization amendment of certain acts related to consumer protection, Decree 49/2003. (VII.30) GKM on the handling of warranty and guarantee claims enforced under consumer contracts, and Act CLV of 1997 on consumer protection.

9. Data protection
The Service Provider's full privacy policy is available in the corresponding menu item of the Webshop.
10. Miscellaneous and final provisions
10.0. Questions not regulated in these GTC shall be governed by the Hungarian Civil Code (Act V of 2013) and other applicable legal provisions.
10.1. The Service Provider informs the Buyer that
a. the annual availability of the servers ensuring its data processing exceeds 99.9%. Regular backups are made in order to protect the data, so in the event of data loss the original content can be restored,
b. the stored information is placed in MSSQL and MySQL databases, and sensitive data is protected with strong encryption, for which we use hardware-based encoding solutions integrated into the processor.
10.2. The Service Provider informs the Buyer that the Sellvio rating system operates on the Webshop website.
a. The rating system does not evaluate individual products, but the operation of the webshop itself, exclusively on the basis of the opinions of real customers.
b. During the review process, the following security and technical measures are applied:
i. The possibility of leaving a review is activated only after a purchase. The system operates independently from the webshop, and the reviews are stored by Sellvio (ErdSoft Kft.: company registration number: 06-09-030198, registered office: 6720 Szeged, Kigyo utca 4.).
ii. A review may only be submitted after the purchase, based on an invitation sent to the provided email address.
iii. It is important to know that neither ratings nor reviews can be deleted - both positive and negative feedback are displayed, so the system provides an authentic picture of the operation of the Webshop.
